Certified Copies under the RTI may be delayed : ICAI

 Dear friends,

Many of you have applied for certified copies of the answer sheets under the Right to Information Act (RTI), 2005. As per law, ICAI has to provide the same within 30days from the date of filing the RTI application.

Few cases are reported, where students didn't receive answer sheets under the RTI even after the 30days, few filed First Appeal also, but again it will take another 30days to get a reply for the First Appeal. And many students received SMS that copies have been sent to the mail but no mail was received by the student.

As lakhs of students are applying for copies under the RTI, it became a tedious task for the ICAI to provide the same within the time limit, as they are carrying out suo-motu verification of marks for the benefit of the students.

Few students received copies even in 10-15days while others didn't receive even after 40-45 days. We don't know exactly how many days it will take to provide the copies but be assured that you'll receive copies from the ICAI and generally average time is around 30-40 days.

And I'm receiving many messages asking whether marks can be deceased under the RTI?

I have written a separate blog post, with relevant official sources and said at many platforms that ICAI WON'T DECREASE MARKS UNDER THE RTI, either they will increase the marks on account of verification or provide the soft copy (even though you have got fewer marks) but, in case ICAI is not going to decrease your marks.

Attached official reply by the ICAI to one of the RTI application, whether they have mentioned copies may be delayed due to HUGE RTI Applications and also provided contact details to reach ICAI, if you haven't received the same even after 30-45 days.
