Whether ICAI will decrease your marks under RTI on suo-motu Verification?

Many students want to check their answer sheet, to know their mistakes, few students who scored good marks want to retain their copy as a memory or to guide his fellows about the presentation, applied for copies under the RTI Act, 2005 or under Institute procedure. But, worried about the possible decrease of marks on suo-motu verification by the ICAI.

A student who scored say, 40 marks (pass) or 60 marks (exemption) in a subject or cleared single or both the groups with exactly 200 or 400 marks are in a panic situation, as what if ? their marks are decreased on suo-motu verification of marks, even though application is made only to view their certified copies without any verification. Will ICAI fail them?

Friends, relax the answer is a big NO !!

Let me say it clear, legally ICAI has no right to carry out suo-motu verification of marks when an application made under the RTI. 


- Nowhere in the RTI application, we asked to carry out verification.


- Nowhere we are intimated about the suo-motu verification carried about by the ICAI through an announcement.

Even, the past ICAI president CA. Prafulla Chhajed sir, during his tenure, said the same in a press meet on 26th of September, 2019. You can watch his speech from the below link:





But, YES ICAI is carrying out suo-motu verification of marks in the interest of the students even when an application is made under RTI for a photocopy of the answer sheet, as decided by the Examination Committee in its 576th meeting held on 17th July 2019 at ICAI Bhavan, New Delhi.


And the good thing is, a chance is also given for the student to report the discrepancy noticed falling under the regulation 39(4) within 30 days from the date of receipt/hosting of copies of answer books.

And also, I sought information under the RTI Act, 2005 of the students whose marks are changed upwards on suo-motu verification of marks upon application received for certified copies under RTI and ICAI.

As ICAI carried out Digital Evaluation, in respect of  Foundation, Intermediate and IPCC for November 2019 examinations, THERE IS NO SINGLE CASE WHERE MARKS ARE CHANGED.


  
 

And also, I sought information under the RTI Act, 2005 of the students whose marks are changed downwards (decreased) on suo-motu verification of marks upon application received for certified copies under RTI and ICAI.

And ICAI replied, "there is no concept of decreasing the marks" after verification process both under the RTI and ICAI procedure.

 
 
To conclude, ICAI does not decrease your marks on verification or suo-motu verification of marks. We all built-up a negative image on ICAI, that they will blacklist the students when application made under RTI, ICAI will fail the students if applied under RTI as we are not paying Rs. 500,.......these all are the common messages received by me regularly.

Believe me, ICAI acts positively towards the students, we are the future members of the ICAI who will carry out the legacy of this glorious profession. Yes, there is a lack of proper channel between the students and ICAI, I has full trust in our newly elected president CA. Atul Gupta sir, who is known for revolutionary changes under his tenure as a chairman at Board of Studies of the ICAI.

      No we cannot. ICAI said it cannot provide the same as they have limited Question Bank and they have copyright on that.

      NO!

      Stay assured that, marks won't be decreased at any cost under the RTI and at the same time if there's any scope of increase of marks, definitely ICAI will increase the marks and send a revised Mark Sheet to give effect of the same.

I got dot 40 in tax was in tension from the morning what should I do now thanks for the article. Again asking you in case I'm getting less than 40 in the verification process are there any possibilities that they will change my result from pass to fail?

      NO!

      There may be a possibilty that in the certified copies you will receive you may have scored less than 40, although in the result declared you have scored 40, it is beacuse of Grace Marks awarded by the ICAI.     For eg if there is any totalling mistake by paper checker and student is awarded more marks will icai reduce it in suo moto verification?

    1. Dear Harsh Raval,
      No ICAI won't decrease the marks even though you have scored more marks due to totalling error (although it's very rare)

      See, ICAI increases the marks just to give benefit the student

      And, Generally, you'll see in the Marksheet marks will be more than the marks scored in Answer Sheet, this is due to Grace Marks awarded by the ICAI almost in the every attempt.

      Legally also, ICAI cannot decrease your marks under the RTI, as you have only sought Photocopy of the Answer Sheet. There's no provision under the RTI to do suo motu verification, but ICAI is doing so in the interest of the students.

    3. Yes, ICAI can give Grace Marks in more than one subject also.

  9. Hello..
    I have read this article today.. I have applied for certified copies under RTI on 31st Jan.. I have cleared Group1 with exact 40 in taxation.. my question is if there is a difference between marks of certified copies and marks given in my result and the marks in certified copies is actually less than my marks in my result, shall it be concluded as Grace marks? Will my result change from PASS to FAIL?
    Sorry to ask this because I am actually tensed.. Will this affect my result? Thanks for the reply in advance😊

      Don't worry at all.

      Yes, it can be considered as Grace marks.

      At any cost marks awarded in the Result Card won't be decreased, but if there's any increase of Marks, they will give effect to the same for the benefit of the student.

    I read the article, as you said not to worry about deductions but at some places you have written YES they can.. so I'm again having mixed feelings..
    I have passed but got exact 40 in law and I have already applied for rti..
    Can u pls confirm whether I'm safe from deduction risks (like 100% safe) or not

    1. Hi Rohit,
      If you apply under RTI, there's no scope for decrease of marks.

      Under RTI you're asking only for photocopy, nothing more than that.
