Whether Answer Sheets of Rank Holders/ Others can be sought under RTI?

The answer is NO !!.

In one of the case, student-written his short name Vinay instead of full name as per records and applications stands rejected.


You can’t file RTI Application to get a copy of the answer sheets of a third party, as the same is personal information and disclosure of which doesn’t serve the larger public interest, which is exempted under section 8(1)(j) of the RTI Act, 2005.
Extract of Section 8(1)(e) of The Right To Information Act, 2005 was reproduced here for your reference:
    "(e) information available to a person in his fiduciary relationship, unless the      competent authority is satisfied that the larger public interest warrants the disclosure          of such information;"
Section 8(1)(j) in The Right To Information Act, 2005
(j) information which relates to personal information the disclosure of which has not relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information, which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.

Some Landmark Judgements:

CIC (Central Information Commissioner) in a Landmark Judgment held that, a candidate can seek answer sheets of other candidates and that this is not barred by Section 8(1)(e) and Section 8(1)(j) of RTI Act. However, it is subject to Sections 3 and 6.
